Tier 5 Unemployment Extension Update - Help for 99ers?

If you are reading this, you are likely one of the millions of Americans who are seeking good information on the important Tier 5 situation. Below, we provide an update on previous proposals, as well as a recent proposal.

Quick Background

If implemented, a Tier 5 would add additional weeks of unemployment benefits. To date, the previous extensions passed by Congress (including the December 2010 extension) have only extended eligibility for existing tiers, enabling you to receive up to a maximum of 99 weeks in most states. These extensions have helped millions, but have not provided any additional weeks for the hundreds of thousands of Americans who have already exhausted their benefits.

Previous Proposals

Americans Want to Work Act

Introduced by Senator Stabenow of Michigan, this bill would provide the following:

  • An additional 20 weeks of benefits for people who have had their benefits expire, as long as the unemployment rate in your state is at least 7.5%.
  • It would offer businesses a $2,000 tax break for hiring workers who have exhausted unemployment benefits.

As proposed, the bill would offer eligiblity retroactively, meaning that if you have already finished your previous tiers in recent months, you would still be eligibile.

Emergency Unemployment Compensation Extension Act

Introduced by Representative Berkley of Nevada, this is similar, but would apply to fewer states.

  • Would provides an additional 20 weeks of benefits for people who have had their benefits expire, as long as the unemployment rate in your state is at least 10%.

Only a handful of states would meet the 10% unemployment rate threshold.

NEW Proposal

Representatives Barbara Lee (D-CA) and Bobby Scott (D-VA) have been working on a new bill that would help the 99ers. The proposal contains the following provisions:

  • Provides 14 additional weeks of emergency unemployment compensation in Tier 1.
  • These additional weeks will be available for those who have exhausted all their benefits (99ers and other exhaustees) as well as those who will be unemployed this year.
  • This extension would be similar to the November 2009 extension, which provided additional weeks of benefits to Tier 2.
  • Adding these extra weeks in Tier 1 makes them available for all long-term unemployed and not only those who live in a “high unemployment state.”

The latest that we have heard is that further discussions are likely to take place in early March.

During four years of his presidency, he could have rolled up his sleeves doing dirty job for anybody to pick up the mess that had been left, and do the brunt of work punishing the mortgagers and bankers who wreck the havoc of the economy in the U.S.–this would show his willingness how seriously he was fixing up the economy.     I just basically got my benefits cut off. I am passed my tier 4 but only collected for maybe 60 -70 weeks tops but no matter what i do unemployment won’t seem to let me restart my claim or anything. why is it then that 99 was supposed to be the max but i got cut off like half a year early?

    P.S. live in a rural area and it’s about 120 miles to nearest job round trip. That’s why i am having such difficulty and now i have nothing atm!!

    Unemployment insurance benefits will continue. Congress passed, and the President signed into law, legislation that temporarily extends the benefits through the end of February. The action was part of the two-month renewal of the payroll tax cut.
    The decision means that individuals who have collected unemployment insurance benefits from Illinois for fewer than 113 weeks will continue to do so. The decision adds additional weeks to programs.
    Under current law, the number of weeks of unemployment benefits available to an Illinois claimant will generally range from a minimum of 25 to a maximum of 113; however, not everyone will be entitled to the maximum number of weeks. The number of payable weeks of emergency unemployment compensation (EUC) and extended benefits (EB) depends on whether an individual meets the EB and EUC eligibility criteria, when an individual’s claim was initially filed and the federal phase out rules.
    The maximum 113 weeks of benefits include
    26 weeks of regular state benefits,
    53 weeks of EUC, in four separate tiers of 20, 14, 13 and 6 weeks,
    20 weeks of EB.
    14 weeks EB tier5
    The legislation has established the following cutoff dates for the EUC and EB programs;

    I have been unemployed for nearly two years now. I have run out of benefits. Like most Americans in my situation, I would love to have work. I am unable to relocate for work. The court systems in this country have made that impossible. They do not give justice to a man with children. So I am stuck in a down economy in an area with over 14% unemployment rate. 700 applicants or more per position available. So you say I want this? You say I choose to not have a job? Well my friend, I hope the day I turn to a life of crime, due to people like you, you are one of my victims. Feel the rage of those walked on. We want to be productive members of society, and are being held back by the fatcats. Our own government isn’t doing a damn thing about it either.

    To all that have been on unemployment for months/years.. I wish you all the luck. It’s brutal out there. I live in the city with the highest unemployment rate in the country. We are also #1 in home foreclosure, bankruptcy and auto repos. No, I don’t mean Detroit, I’m talking about Las Vegas, which was once the fastest growing city in the country and we had the lowest unemployment rate. This recession has hit my city HARD. There are simply not enough jobs out there, for all the unemployed. My Walmart greeter has 2 college degrees and took what ever job he could find. McDonalds was hiring 600 employees for extended hours and new locations opening. More than 7,000 people applied. We have 6,000 homeless families here. Kids living on the street! It’s a disgrace to this once great city. 78% of kids in public schools are on free lunch. For you ignorant people who think people are just lazy and want to live off the system, I suggest you kill yourself. You actually think people want to live this way? Everyone here is desperate for work and look for work on a regular basis. I am blessed to have kept my job through this recession, I know MANY who struggle and have lost everything. Not saying that a tier 5 is going to fix the problems, but any help for these families is better than what they are experiencing now. I love these arrogant asses insulting these people. I hope one day you lose everything, and your kids have to go to bed hungry.Maybe, then you will realize the reality of this recession. You are lousy human beings and horrible Americans.

Have lost a few neighbors due to foreclosure. You are a moron if you think all we do here is “make babies and gamble”. People who have lost their jobs and homes, can’t afford to relocate. Takes a lot of money for a family to relocate out of state. If they can’t pay their rent/mortgage, how can they afford to move? This was once the land of opportunity. Those days are long gone.     I do know that there are a lot of us out there looking for work. We are trying to keep food on the table and a roof over our heads. I live in Indiana and in October of 2011 the minds in Indpls had decided to take away Tier 4 and put us all on the EB then they changed their minds and now we are not elegible for the 2 month extensions or the most recent extension that passed on 2/17/12… I am not going to say any bad words – but about 2 grand in the hole to my landlord and I can not find a job because in 1993 I broke a window and was charged with a burglary of a business…. Yes I did do the crime and I did my time. But how can anyone survive when the first question is ” Have you been convicted….” I have not been in any trouble since 1993… And I live in Franklin Indiana.
